In conjunction with the release of Llama 3.1 Swallow, we initially stated that “Llama 3.1 Swallow is available for both research and commercial purposes, provided that users comply with the Meta Llama 3.1 Community License.” However, these two models were instruction-tuned on synthetic data generated by Google Gemma 2:
According to Section 1.1 (e) (iii) of the Google Gemma Terms of Use, these models fall under the category of “Model Derivative” of Gemma. After careful consideration by the Swallow team, we have determined that, in addition to adhering to the Meta Llama 3.1 Community License, these two models must also comply with the usage restrictions outlined in Section 3.2 of the Gemma Terms of Use.
Consequently, we are amending the terms of use for Llama 3.1 Swallow 8B Instruct and Llama 3.1 Swallow 70B Instruct as follows: “Llama 3.1 Swallow Instruct is available for both research and commercial purposes, provided that uses comply with the Meta Llama 3.1 Community License and do not violate the Use Restriction set forth in the Gemma Terms of Use.” We have also updated the distribution packages of these models to reflect this change. Notably, the base models for Llama 3.1 Swallow 8B and Llama 3.1 Swallow 70B were not constructed using synthetic data from Google Gemma 2; therefore, their licenses and terms of use remain unchanged.
